Terms & Conditions Blue Health Intelligence
The Dutch terms and conditions are leading if there is any discrepancy between the dutch and english terms & conditions.
Article 1 – Definitions
Blue Health Intelligence: The trade name of the private limited liability company Tiuri Health B.V., registered with the Chamber of Commerce under number 98047213, established in Amsterdam at Linnaeushof 81-H, which is the drafter of these General Terms and Conditions.
Member: the natural person who purchases Services from Blue Health Intelligence pursuant to the Agreement.
Parties: the Member and Blue Health Intelligence together.
Services: the performance of preventive health checks and examinations, including blood tests, biomarkers, body measurements, and disease risk analysis. In execution thereof, a medical treatment agreement as referred to in Article 7:465 of the Dutch Civil Code will be concluded between the Member and Blue Health Intelligence.
General Terms and Conditions: the present General Terms and Conditions of Delivery of Blue Health Intelligence.
Agreement: the treatment agreement whereby Blue Health Intelligence commits itself to the Member to perform acts in the field of medicine, directly relating to that Member. This treatment agreement is concluded in accordance with Article 7:446 of the Dutch Civil Code.
Anamnesis: A health questionnaire administered by Blue Health Intelligence and discussed with the Member, containing questions relating to his/her state of health.
Account: The personal profile that the Member creates or receives to gain access to the Blue Health Intelligence Application. The Account is strictly personal and non-transferable.
Application: The mobile Application and/or web environment of Blue Health Intelligence through which the Member gains access to reports, biomarker insights, advice, and other digital functionalities offered by Blue Health Intelligence.
Invitation Codes: A code or codes that can be used to book an appointment for the performance of Services and/or to obtain a discount on Services. ● Gift card: is a prepaid voucher accepted by Blue Health Intelligence as a (partial) means of payment for products or services from that issuer, within the applicable terms and conditions. The gift card does not represent cash, but a claim for the future delivery of services or products, and is subject to restrictions such as validity, redeemability, and refund.
Subscription: A monthly cancellable subscription to the Application in which the Member is provided with additional (health) information and digital functionalities.
Article 2 – Applicability
2.1 These General Terms and Conditions apply to all Agreements between Blue Health Intelligence and the Member.
2.2 Deviations from these General Terms and Conditions apply only if agreed upon in writing and exclusively to the Agreement in question.
2.3 If provisions of these General Terms and Conditions are null and void or are annulled, the remaining provisions shall remain valid. In that case, the parties shall agree on a replacement provision in consultation.
2.4 Where ‘in writing’ is mentioned, this also includes communication via digital means.
Article 3 – Additional explanation regarding the Services
3.1 The health check is intended to provide an overview of your health and to identify possible risk factors or abnormalities that may warrant follow-up in regular care. The results are informative and do not constitute a guarantee regarding your current or future health.
3.2 Blue Health Intelligence does not make a medical diagnosis, offer treatment, prescribe medication, or replace care by your general practitioner or medical specialist.
Article 4 – Formation and Amendment of the Agreement
4.1 The Agreement is formed as soon as the Member books a check-up via the website or app and Blue Health confirms that check-up, after acceptance of the General Terms and Conditions.
4.2 Written agreements, including the completed anamnesis and Consent Form and these General Terms and Conditions, form an integral part of the Agreement and supersede previous agreements.
4.3 Oral promises made by employees of Blue Health Intelligence are binding on Blue Health Intelligence only if confirmed in writing by an authorized representative.
4.4 Amendments to or additions to the Agreement are only valid if Blue Health Intelligence confirms this in writing.
4.5 Blue Health Intelligence has the right at all times to refuse the Member based on valid reasons, such as medical contraindications. In that case, no agreement is formed and Blue Health Intelligence offers a full refund of the amount already paid.
Article 5 – Prices and Rates
5.1 The price for the Services is stated on the website bluehealth.co and may be adjusted from time to time. If payment has already been made, the price can no longer be adjusted. The rates for the Services are determined in accordance with the Wmg.
5.2 Access to the Subscription app represents a value per month and is provided free of charge for a period of 13 months upon purchase of the Services.
5.3 If the Member has booked and paid for another preventive health examination within 13 months of purchasing the Services, the free access to the Subscription will be extended for 13 months.
5.4 If the Member has not booked and paid for a follow-up examination within 13 months after the first preventive health examination, they will be given the option to purchase a monthly subscription to maintain access to the Application. To do so, they can send an email to info@bluehealth.co. You may always request your information by email for up to 20 years after the last contact and/or examination, unless laws and regulations prescribe a different retention period. The Member is clearly informed of the content, duration, price, and cancellation options prior to entering into the Subscription.
5.5 The Subscription is automatically renewed for one month each time. Cancellation by the Member may take place at any time, subject to a notice period of one calendar month. For example: a cancellation received in the month of November therefore becomes effective as of January 1.
Article 6 – Invoicing and Payment
6.1 The Member pays the amount for the preventive health examination prior to the appointment, simultaneously with the online booking.
6.2 The Member is solely responsible for any claims submitted to his/her health insurer or employer. Blue Health Intelligence provides no guarantee whatsoever regarding reimbursements.
6.3 If the Member fails to pay or does not pay on time, i.e., before the scheduled date of the Services, Blue Health Intelligence will not perform the preventive health examination. In the event of a chargeback after the preventive health examination, statutory interest and collection costs may be charged.
6.4 Payments are first allocated to outstanding costs and interest, and subsequently to the outstanding invoice amount.
6.5 The payment service is provided by Adyen N.V. Adyen's privacy policy can be found at: https://www.adyen.com/nl_NL/legal/privacy-policy. The available payment options are displayed at the moment the Member connects to the payment service.
6.6 Blue Health Intelligence does not charge any fees for payments made via the payment service. However, depending on the payment option chosen by the Member, additional costs may apply, as stated in the terms and conditions applicable to the relevant payment option.
Article 7 – Execution of the Agreement
7.1 Blue Health Intelligence strives to provide the results of the preventive health examination during the visit. Should this not be possible, Blue Health Intelligence will provide the results as soon as possible.
7.2 Blue Health Intelligence may only perform the Services after the Agreement has been concluded, the necessary information and consent form have been provided by the Member, and payment has been received.
7.3 The Member is personally responsible for the accuracy and completeness of all information provided.
7.4 Blue Health Intelligence may outsource the execution of Services in whole or in part to third parties, but remains ultimately responsible.
Article 8 – Complaints and Disputes
8.1 Blue Health Intelligence has a complaints and disputes procedure in place, through which it ensures effective and accessible reception and handling of complaints. This complaints and disputes procedure complies with the requirements set by the Healthcare Quality, Complaints and Disputes Act (Wkkgz).
8.2 Information regarding this, including the complaints procedure and dispute resolution body, can be found on the Blue Health Intelligence website.
Article 9 – Modification and Cancellation of Services
9.1 An appointment may be modified or cancelled free of charge up to 48 hours before the scheduled time.
9.2 An appointment may be rescheduled free of charge a maximum of two times if done up to 48 hours in advance. A third modification counts as a cancellation and results in a settlement of costs in accordance with paragraph 5.
9.3 An appointment rescheduled between 48 and 12 hours in advance will be charged half of the amount.
9.4 If the Member arrives late for their booked appointment, due to the limited duration of the reservation, it may only be possible to provide a portion of the Services, depending on the remaining time of the appointment.
9.5 In the event of a no-show, the Member owes the full amount; no refund will be given.
9.6 Exceptions are possible in cases of demonstrable force majeure (serious illness, accident, death in the immediate circle, or medical necessity confirmed by a doctor).
9.7 Cancellations must be confirmed in writing or digitally. 9.8 If the Member terminates an examination prematurely for reasons on his/her part, there is no right to a refund or a new appointment.
Article 10 – Modification and Cancellation of Subscription
10.1 If the Member purchases a Subscription from Blue Health Intelligence, the Member has the right to revoke the agreement within 14 days of purchase without giving reasons if he/she expressly requests this (“withdrawal period” Art. 6:230p BW).
10.2 To exercise your right of withdrawal, the Member can contact us via info@bluehealth.co. If desired, we offer the Member support in cancelling your purchase.
Article 11 – Confidential Data
11.1 The parties are obliged to maintain confidentiality regarding all (medical) information they obtain in the context of the Agreement. This also applies to all employees of Blue Health Intelligence.
11.2 Blue Health Intelligence processes (special) personal data in accordance with the GDPR and its Privacy Statement, which can be found on the website. 11.3 If Blue Health Intelligence is legally obliged, or is obliged pursuant to a judicial decision, to provide confidential data to third parties designated by law or by the competent court, and it cannot invoke a statutory privilege or a privilege recognized or permitted by the competent court in this regard, then Blue Health Intelligence shall not be liable for damages or compensation to the Member. Blue Health Intelligence shall notify the Member in writing before proceeding to (legitimately) breach professional secrecy. Blue Health Intelligence shall ensure the breach of professional secrecy is as minimal as possible.
11.4 Blue Health Intelligence may use anonymized case studies for publications, presentations, general quality improvement, and innovations with automated systems, provided that the privacy of the Member remains guaranteed.
Article 12 – Intellectual Property Rights
12.1 Blue Health Intelligence, or third parties from whom we acquire rights, are and remain the owner of all rights to the Application. These rights comprise both registered and unregistered, existing and future intellectual property rights, including trademarks, patents, models, designs, software, copyrights, know-how and other similar intellectual property rights, whether registrable or not, related to the Application. No transfer of such rights takes place and nothing in this Agreement shall be construed as a transfer of such rights to the Member.
12.2 Blue Health Intelligence generally reserves all intellectual property rights to which it is entitled by law.
12.3 All documents, reports, advice, and software provided by Blue Health Intelligence are intended exclusively for use by the Member themselves and may not be reproduced or shared without permission, with the exception of sharing the data with healthcare professionals for the benefit of the Member's health.
12.4 Blue Health Intelligence may use acquired knowledge for other purposes, provided that confidential information of the Member is not shared.
Article 13 – Liability of Blue Health Intelligence
13.1 Blue Health Intelligence is responsible and liable for the performance of the Agreement in accordance with the law.
13.2 Blue Health Intelligence is not responsible or liable for the assistance provided by third parties to whom referrals are made; these service providers enter into an agreement with the Member themselves and are themselves responsible and liable for the performance thereof.
13.3 Within the framework of the Subscription, Blue Health Intelligence is only liable for direct damage resulting from intent or gross negligence. Within the context of the Services and the Agreement, Blue Health Intelligence is liable only for direct damage resulting from an attributable failure in the provision of care.
13.4 Blue Health Intelligence is not liable for consequential damage, indirect damage, business damage, or loss of profit.
13.5 Disruptions in electronic services (internet, app, telecom) fall outside liability.
13.6 The Services are not intended to replace regular visits to healthcare providers or doctors for medical advice, diagnosis, or treatment, but should be regarded solely as a supplement thereto. Do not delay seeking medical advice because of the Services. In the event of urgent complaints or emergency problems, the Member must immediately turn to emergency care or another form of acute medical care.
13.7 Blue Health Intelligence is responsible for ensuring that all doctors involved with it possess the required qualifications and professional liability insurance, and that they are registered in the relevant (inter)national BIG or medical register with a valid authorization to practice their profession.
Article 14 – Use of Account and Application
14.1 The Member is responsible for all activities that take place through the use of the Account or as a result of his/her access to or use of the Application.
14.2 If the Member suspects that information regarding access to the Account has become known to a third party, the Member must notify Blue Health Intelligence immediately.
14.3 A Member may maintain only one Account at all times.
14.4 It is not permitted to use the Application in a manner that may disrupt the functionality of the Application or cause damage to Blue Health Intelligence.
14.5 The Member is responsible for ensuring that the Account or the data contained therein are not used or permitted to be used for purposes that are contrary to applicable laws or regulations, or to ethical standards or guidelines.
14.6 Any use of the Application other than as expressly permitted under this Agreement is prohibited and may also constitute a criminal offense and lead to liability for damages.
14.7 We strive to ensure that the Application is functional and available to the Member. However, the Member understands that the Application and its functionalities may change from time to time and that Blue Health Intelligence provides no guarantee regarding any specific functionality or availability.
Article 15 – Invitation Codes and Gift Cards
15.1 Blue Health Intelligence may issue various types of “Invitation Codes” from time to time. An Invitation Code is a code that can be used to book an appointment for the provision of Services and/or to obtain a discount on Services. Depending on the type of Invitation Code, the Services may be offered to the recipient of the Invitation Code free of charge or at a discount. The number of times an Invitation Code can be used to book may be limited.
15.2 An Invitation Code has no monetary value and cannot be redeemed for other Services or for any form of compensation.
15.3 It is not permitted to transfer an Invitation Code for payment.
15.4 Blue Health Intelligence reserves the right to withdraw or invalidate an Invitation Code at any time and without prior notice.
15.5 Gift cards (“Gift Cards”) issued by Blue Health Intelligence can only be redeemed for products and/or services offered by Blue Health Intelligence, unless expressly stated otherwise. 15.6 Gift Cards do not represent cash and cannot be exchanged for cash, refunded, or offset against outstanding claims, unless required by law.
15.7 Gift Cards are valid for one year, or until the expiry date stated on the card or in the accompanying communication. Upon expiry of the validity period, the remaining balance expires without entitlement to a refund.
15.8 If the purchase amount exceeds the balance on the Gift Card, the remaining amount must be paid by the customer via a payment method accepted by Blue Health Intelligence. If the purchase amount is lower than the balance, the remaining balance remains available until the expiry date.
15.9 Unless stated otherwise, Gift Cards are transferable and may be used by the holder. Blue Health Intelligence is not responsible for loss, theft, misuse, or unauthorized use of a Gift Card. 15.10 If a service booked with a Gift Card is cancelled in accordance with Blue Health Intelligence's applicable cancellation conditions, the amount paid will be refunded as credit on the Gift Card and will not be paid out in cash.
15.11 Blue Health Intelligence reserves the right to block or invalidate Gift Cards in the event of (suspected) fraud, abuse, or other irregularities.
15.12 Blue Health Intelligence reserves the right to amend the terms and conditions for Gift Cards, provided that Gift Cards already issued remain subject to the terms and conditions applicable at the time of issuance, unless otherwise prescribed by law.
15.13 If medical, legal, or professional guidelines require it, Blue Health Intelligence may refuse to perform a service booked with a Gift Card. In that case, the amount will be refunded as credit on the Gift Card.
Article 16 – Force Majeure
16.1 In the event of force majeure, Blue Health Intelligence may suspend the performance of its obligations until the situation has been resolved. Blue Health Intelligence shall notify the Member thereof.
16.2 Force majeure includes, among other things, network failures, provider outages, or unforeseen circumstances beyond the control of Blue Health Intelligence.
Article 17 – Duration and Termination
17.1 The Parties may terminate the Agreement with immediate effect in the event of:
a) bankruptcy, suspension of payments, or debt restructuring of the other party;
b) death of the Member;
c) serious breach of contract making continuation unreasonable.
17.2 Dissolution does not entitle the Member to a refund of amounts already paid, unless otherwise agreed.
17.3 The Agreement remains valid as long as the Member holds an Account, uses the Application, or has access to the Services. 17.4 The Member may cancel the Account at any time by contacting us via info@bluehealth.co
17.5 Blue Health Intelligence has the right to terminate the Agreement with immediate effect, including the termination of the Account, in the event of a serious or repeated breach of the Agreement. This does not affect the right to request the patient file for the statutory retention period of 20 years, unless laws and regulations prescribe a different retention period.
17.6 You understand that the provision of your Account and the Application by Blue Health Intelligence does not entail an obligation to store information about the Member, other than to the extent necessary for the provision of the Services and within the framework of the medical retention obligation. After termination of your Account, the Member will no longer have access to your Account.
17.7 Blue Health Intelligence may decide at any time to modify the Services or to cease offering them. Where possible, we will notify the Member of this in writing in advance.
Article 18. Changes to the Services and Terms
18.1 Blue Health Intelligence has the right to amend these General Terms and Conditions. We will notify the Member in writing of such changes before they take effect.
18.2 By (continuing to) use the Application or maintaining access to the Services after the change has taken effect, the Member is deemed to have accepted the change.
18.3 If the Member does not accept the amended General Terms and Conditions, the Member may no longer be able to use the Application or the Services.
Article 19. Notifications
19.1 Written notifications from Blue Health Intelligence to the Member will be sent by e-mail or SMS to the contact details provided by the Member via the Account, or – for changes to the Services or these General Terms and Conditions – via the Application.
19.2 Written communication from the Member to Blue Health Intelligence must be addressed to: info@bluehealth.co or care@bluehealth.co
Article 20 – Applicable law and competent court
20.1 All legal relationships with Blue Health Intelligence are governed exclusively by Dutch law.
20.2 Disputes shall be submitted to a competent court in Amsterdam.

11.1 The parties are obliged to maintain confidentiality regarding all (medical) information they obtain in the context of the Agreement. This also applies to all employees of Blue Health Intelligence.
11.2 Blue Health Intelligence processes (special) personal data in accordance with the GDPR and its Privacy Statement, which can be found on the website. 11.3 If Blue Health Intelligence is legally obliged, or is obliged pursuant to a judicial decision, to provide confidential data to third parties designated by law or by the competent court, and it cannot invoke a statutory privilege or a privilege recognized or permitted by the competent court in this regard, then Blue Health Intelligence shall not be liable for damages or compensation to the Member. Blue Health Intelligence shall notify the Member in writing before proceeding to (legitimately) breach professional secrecy. Blue Health Intelligence shall ensure the breach of professional secrecy is as minimal as possible.
11.4 Blue Health Intelligence may use anonymized case studies for publications, presentations, general quality improvement, and innovations with automated systems, provided that the privacy of the Member remains guaranteed.
Article 12 – Intellectual Property Rights
12.1 Blue Health Intelligence, or third parties from whom we acquire rights, are and remain the owner of all rights to the Application. These rights comprise both registered and unregistered, existing and future intellectual property rights, including trademarks, patents, models, designs, software, copyrights, know-how and other similar intellectual property rights, whether registrable or not, related to the Application. No transfer of such rights takes place and nothing in this Agreement shall be construed as a transfer of such rights to the Member.
12.2 Blue Health Intelligence generally reserves all intellectual property rights to which it is entitled by law.
12.3 All documents, reports, advice, and software provided by Blue Health Intelligence are intended exclusively for use by the Member themselves and may not be reproduced or shared without permission, with the exception of sharing the data with healthcare professionals for the benefit of the Member's health.
12.4 Blue Health Intelligence may use acquired knowledge for other purposes, provided that confidential information of the Member is not shared.
Article 13 – Liability of Blue Health Intelligence
13.1 Blue Health Intelligence is responsible and liable for the performance of the Agreement in accordance with the law.
13.2 Blue Health Intelligence is not responsible or liable for the assistance provided by third parties to whom referrals are made; these service providers enter into an agreement with the Member themselves and are themselves responsible and liable for the performance thereof.
13.3 Within the framework of the Subscription, Blue Health Intelligence is only liable for direct damage resulting from intent or gross negligence. Within the context of the Services and the Agreement, Blue Health Intelligence is liable only for direct damage resulting from an attributable failure in the provision of care.
13.4 Blue Health Intelligence is not liable for consequential damage, indirect damage, business damage, or loss of profit.
13.5 Disruptions in electronic services (internet, app, telecom) fall outside liability.
13.6 The Services are not intended to replace regular visits to healthcare providers or doctors for medical advice, diagnosis, or treatment, but should be regarded solely as a supplement thereto. Do not delay seeking medical advice because of the Services. In the event of urgent complaints or emergency problems, the Member must immediately turn to emergency care or another form of acute medical care.
13.7 Blue Health Intelligence is responsible for ensuring that all doctors involved with it possess the required qualifications and professional liability insurance, and that they are registered in the relevant (inter)national BIG or medical register with a valid authorization to practice their profession.
Article 14 – Use of Account and Application
14.1 The Member is responsible for all activities that take place through the use of the Account or as a result of his/her access to or use of the Application.
14.2 If the Member suspects that information regarding access to the Account has become known to a third party, the Member must notify Blue Health Intelligence immediately.
14.3 A Member may maintain only one Account at all times.
14.4 It is not permitted to use the Application in a manner that may disrupt the functionality of the Application or cause damage to Blue Health Intelligence.
14.5 The Member is responsible for ensuring that the Account or the data contained therein are not used or permitted to be used for purposes that are contrary to applicable laws or regulations, or to ethical standards or guidelines.
14.6 Any use of the Application other than as expressly permitted under this Agreement is prohibited and may also constitute a criminal offense and lead to liability for damages.
14.7 We strive to ensure that the Application is functional and available to the Member. However, the Member understands that the Application and its functionalities may change from time to time and that Blue Health Intelligence provides no guarantee regarding any specific functionality or availability.
Article 15 – Invitation Codes and Gift Cards
15.1 Blue Health Intelligence may issue various types of “Invitation Codes” from time to time. An Invitation Code is a code that can be used to book an appointment for the provision of Services and/or to obtain a discount on Services. Depending on the type of Invitation Code, the Services may be offered to the recipient of the Invitation Code free of charge or at a discount. The number of times an Invitation Code can be used to book may be limited.
15.2 An Invitation Code has no monetary value and cannot be redeemed for other Services or for any form of compensation.
15.3 It is not permitted to transfer an Invitation Code for payment.
15.4 Blue Health Intelligence reserves the right to withdraw or invalidate an Invitation Code at any time and without prior notice.
15.5 Gift cards (“Gift Cards”) issued by Blue Health Intelligence can only be redeemed for products and/or services offered by Blue Health Intelligence, unless expressly stated otherwise. 15.6 Gift Cards do not represent cash and cannot be exchanged for cash, refunded, or offset against outstanding claims, unless required by law.
15.7 Gift Cards are valid for one year, or until the expiry date stated on the card or in the accompanying communication. Upon expiry of the validity period, the remaining balance expires without entitlement to a refund.
15.8 If the purchase amount exceeds the balance on the Gift Card, the remaining amount must be paid by the customer via a payment method accepted by Blue Health Intelligence. If the purchase amount is lower than the balance, the remaining balance remains available until the expiry date.
15.9 Unless stated otherwise, Gift Cards are transferable and may be used by the holder. Blue Health Intelligence is not responsible for loss, theft, misuse, or unauthorized use of a Gift Card. 15.10 If a service booked with a Gift Card is cancelled in accordance with Blue Health Intelligence's applicable cancellation conditions, the amount paid will be refunded as credit on the Gift Card and will not be paid out in cash.
15.11 Blue Health Intelligence reserves the right to block or invalidate Gift Cards in the event of (suspected) fraud, abuse, or other irregularities.
15.12 Blue Health Intelligence reserves the right to amend the terms and conditions for Gift Cards, provided that Gift Cards already issued remain subject to the terms and conditions applicable at the time of issuance, unless otherwise prescribed by law.
15.13 If medical, legal, or professional guidelines require it, Blue Health Intelligence may refuse to perform a service booked with a Gift Card. In that case, the amount will be refunded as credit on the Gift Card.
Article 16 – Force Majeure
16.1 In the event of force majeure, Blue Health Intelligence may suspend the performance of its obligations until the situation has been resolved. Blue Health Intelligence shall notify the Member thereof.
16.2 Force majeure includes, among other things, network failures, provider outages, or unforeseen circumstances beyond the control of Blue Health Intelligence.
Article 17 – Duration and Termination
17.1 The Parties may terminate the Agreement with immediate effect in the event of:
a) bankruptcy, suspension of payments, or debt restructuring of the other party;
b) death of the Member;
c) serious breach of contract making continuation unreasonable.
17.2 Dissolution does not entitle the Member to a refund of amounts already paid, unless otherwise agreed.
17.3 The Agreement remains valid as long as the Member holds an Account, uses the Application, or has access to the Services. 17.4 The Member may cancel the Account at any time by contacting us via info@bluehealth.co
17.5 Blue Health Intelligence has the right to terminate the Agreement with immediate effect, including the termination of the Account, in the event of a serious or repeated breach of the Agreement. This does not affect the right to request the patient file for the statutory retention period of 20 years, unless laws and regulations prescribe a different retention period.
17.6 You understand that the provision of your Account and the Application by Blue Health Intelligence does not entail an obligation to store information about the Member, other than to the extent necessary for the provision of the Services and within the framework of the medical retention obligation. After termination of your Account, the Member will no longer have access to your Account.
17.7 Blue Health Intelligence may decide at any time to modify the Services or to cease offering them. Where possible, we will notify the Member of this in writing in advance.
Article 18. Changes to the Services and Terms
18.1 Blue Health Intelligence has the right to amend these General Terms and Conditions. We will notify the Member in writing of such changes before they take effect.
18.2 By (continuing to) use the Application or maintaining access to the Services after the change has taken effect, the Member is deemed to have accepted the change.
18.3 If the Member does not accept the amended General Terms and Conditions, the Member may no longer be able to use the Application or the Services.
Article 19. Notifications
19.1 Written notifications from Blue Health Intelligence to the Member will be sent by e-mail or SMS to the contact details provided by the Member via the Account, or – for changes to the Services or these General Terms and Conditions – via the Application.
19.2 Written communication from the Member to Blue Health Intelligence must be addressed to: info@bluehealth.co or care@bluehealth.co
Article 20 – Applicable law and competent court
20.1 All legal relationships with Blue Health Intelligence are governed exclusively by Dutch law.
20.2 Disputes shall be submitted to a competent court in Amsterdam.

The Dutch terms and conditions are leading if there is any discrepancy between the dutch and english terms & conditions.
Article 1 – Definitions
Blue Health Intelligence: The trade name of the private limited liability company Tiuri Health B.V., registered with the Chamber of Commerce under number 98047213, established in Amsterdam at Linnaeushof 81-H, which is the drafter of these General Terms and Conditions.
Member: the natural person who purchases Services from Blue Health Intelligence pursuant to the Agreement.
Parties: the Member and Blue Health Intelligence together.
Services: the performance of preventive health checks and examinations, including blood tests, biomarkers, body measurements, and disease risk analysis. In execution thereof, a medical treatment agreement as referred to in Article 7:465 of the Dutch Civil Code will be concluded between the Member and Blue Health Intelligence.
General Terms and Conditions: the present General Terms and Conditions of Delivery of Blue Health Intelligence.
Agreement: the treatment agreement whereby Blue Health Intelligence commits itself to the Member to perform acts in the field of medicine, directly relating to that Member. This treatment agreement is concluded in accordance with Article 7:446 of the Dutch Civil Code.
Anamnesis: A health questionnaire administered by Blue Health Intelligence and discussed with the Member, containing questions relating to his/her state of health.
Account: The personal profile that the Member creates or receives to gain access to the Blue Health Intelligence Application. The Account is strictly personal and non-transferable.
Application: The mobile Application and/or web environment of Blue Health Intelligence through which the Member gains access to reports, biomarker insights, advice, and other digital functionalities offered by Blue Health Intelligence.
Invitation Codes: A code or codes that can be used to book an appointment for the performance of Services and/or to obtain a discount on Services. ● Gift card: is a prepaid voucher accepted by Blue Health Intelligence as a (partial) means of payment for products or services from that issuer, within the applicable terms and conditions. The gift card does not represent cash, but a claim for the future delivery of services or products, and is subject to restrictions such as validity, redeemability, and refund.
Subscription: A monthly cancellable subscription to the Application in which the Member is provided with additional (health) information and digital functionalities.
Article 2 – Applicability
2.1 These General Terms and Conditions apply to all Agreements between Blue Health Intelligence and the Member.
2.2 Deviations from these General Terms and Conditions apply only if agreed upon in writing and exclusively to the Agreement in question.
2.3 If provisions of these General Terms and Conditions are null and void or are annulled, the remaining provisions shall remain valid. In that case, the parties shall agree on a replacement provision in consultation.
2.4 Where ‘in writing’ is mentioned, this also includes communication via digital means.
Article 3 – Additional explanation regarding the Services
3.1 The health check is intended to provide an overview of your health and to identify possible risk factors or abnormalities that may warrant follow-up in regular care. The results are informative and do not constitute a guarantee regarding your current or future health.
3.2 Blue Health Intelligence does not make a medical diagnosis, offer treatment, prescribe medication, or replace care by your general practitioner or medical specialist.
Article 4 – Formation and Amendment of the Agreement
4.1 The Agreement is formed as soon as the Member books a check-up via the website or app and Blue Health confirms that check-up, after acceptance of the General Terms and Conditions.
4.2 Written agreements, including the completed anamnesis and Consent Form and these General Terms and Conditions, form an integral part of the Agreement and supersede previous agreements.
4.3 Oral promises made by employees of Blue Health Intelligence are binding on Blue Health Intelligence only if confirmed in writing by an authorized representative.
4.4 Amendments to or additions to the Agreement are only valid if Blue Health Intelligence confirms this in writing.
4.5 Blue Health Intelligence has the right at all times to refuse the Member based on valid reasons, such as medical contraindications. In that case, no agreement is formed and Blue Health Intelligence offers a full refund of the amount already paid.
Article 5 – Prices and Rates
5.1 The price for the Services is stated on the website bluehealth.co and may be adjusted from time to time. If payment has already been made, the price can no longer be adjusted. The rates for the Services are determined in accordance with the Wmg.
5.2 Access to the Subscription app represents a value per month and is provided free of charge for a period of 13 months upon purchase of the Services.
5.3 If the Member has booked and paid for another preventive health examination within 13 months of purchasing the Services, the free access to the Subscription will be extended for 13 months.
5.4 If the Member has not booked and paid for a follow-up examination within 13 months after the first preventive health examination, they will be given the option to purchase a monthly subscription to maintain access to the Application. To do so, they can send an email to info@bluehealth.co. You may always request your information by email for up to 20 years after the last contact and/or examination, unless laws and regulations prescribe a different retention period. The Member is clearly informed of the content, duration, price, and cancellation options prior to entering into the Subscription.
5.5 The Subscription is automatically renewed for one month each time. Cancellation by the Member may take place at any time, subject to a notice period of one calendar month. For example: a cancellation received in the month of November therefore becomes effective as of January 1.
Article 6 – Invoicing and Payment
6.1 The Member pays the amount for the preventive health examination prior to the appointment, simultaneously with the online booking.
6.2 The Member is solely responsible for any claims submitted to his/her health insurer or employer. Blue Health Intelligence provides no guarantee whatsoever regarding reimbursements.
6.3 If the Member fails to pay or does not pay on time, i.e., before the scheduled date of the Services, Blue Health Intelligence will not perform the preventive health examination. In the event of a chargeback after the preventive health examination, statutory interest and collection costs may be charged.
6.4 Payments are first allocated to outstanding costs and interest, and subsequently to the outstanding invoice amount.
6.5 The payment service is provided by Adyen N.V. Adyen's privacy policy can be found at: https://www.adyen.com/nl_NL/legal/privacy-policy. The available payment options are displayed at the moment the Member connects to the payment service.
6.6 Blue Health Intelligence does not charge any fees for payments made via the payment service. However, depending on the payment option chosen by the Member, additional costs may apply, as stated in the terms and conditions applicable to the relevant payment option.
Article 7 – Execution of the Agreement
7.1 Blue Health Intelligence strives to provide the results of the preventive health examination during the visit. Should this not be possible, Blue Health Intelligence will provide the results as soon as possible.
7.2 Blue Health Intelligence may only perform the Services after the Agreement has been concluded, the necessary information and consent form have been provided by the Member, and payment has been received.
7.3 The Member is personally responsible for the accuracy and completeness of all information provided.
7.4 Blue Health Intelligence may outsource the execution of Services in whole or in part to third parties, but remains ultimately responsible.
Article 8 – Complaints and Disputes
8.1 Blue Health Intelligence has a complaints and disputes procedure in place, through which it ensures effective and accessible reception and handling of complaints. This complaints and disputes procedure complies with the requirements set by the Healthcare Quality, Complaints and Disputes Act (Wkkgz).
8.2 Information regarding this, including the complaints procedure and dispute resolution body, can be found on the Blue Health Intelligence website.
Article 9 – Modification and Cancellation of Services
9.1 An appointment may be modified or cancelled free of charge up to 48 hours before the scheduled time.
9.2 An appointment may be rescheduled free of charge a maximum of two times if done up to 48 hours in advance. A third modification counts as a cancellation and results in a settlement of costs in accordance with paragraph 5.
9.3 An appointment rescheduled between 48 and 12 hours in advance will be charged half of the amount.
9.4 If the Member arrives late for their booked appointment, due to the limited duration of the reservation, it may only be possible to provide a portion of the Services, depending on the remaining time of the appointment.
9.5 In the event of a no-show, the Member owes the full amount; no refund will be given.
9.6 Exceptions are possible in cases of demonstrable force majeure (serious illness, accident, death in the immediate circle, or medical necessity confirmed by a doctor).
9.7 Cancellations must be confirmed in writing or digitally. 9.8 If the Member terminates an examination prematurely for reasons on his/her part, there is no right to a refund or a new appointment.
Article 10 – Modification and Cancellation of Subscription
10.1 If the Member purchases a Subscription from Blue Health Intelligence, the Member has the right to revoke the agreement within 14 days of purchase without giving reasons if he/she expressly requests this (“withdrawal period” Art. 6:230p BW).
10.2 To exercise your right of withdrawal, the Member can contact us via info@bluehealth.co. If desired, we offer the Member support in cancelling your purchase.

18.3 If the Member does not accept the amended General Terms and Conditions, the Member may no longer be able to use the Application or the Services.
Article 19. Notifications
19.1 Written notifications from Blue Health Intelligence to the Member will be sent by e-mail or SMS to the contact details provided by the Member via the Account, or – for changes to the Services or these General Terms and Conditions – via the Application.
19.2 Written communication from the Member to Blue Health Intelligence must be addressed to: info@bluehealth.co or care@bluehealth.co
Article 20 – Applicable law and competent court
20.1 All legal relationships with Blue Health Intelligence are governed exclusively by Dutch law.
20.2 Disputes shall be submitted to a competent court in Amsterdam.
